In a move aimed at ensuring gender equality and addressing challenges arising from marital discord, the government has amended the CCS (Pension) Rules, 2021. This will allow female government employees or pensioners to nominate their eligible child/children for family pension instead of their spouse after their demise.

This amendment is set to impact cases involving divorce proceedings or those filed under acts such as the Protection of Women from Domestic Violence Act, Dowry Prohibition Act, or the Indian Penal Code, the Department of Pensions and Pensioners' Welfare (DoP&PW) said in a statement.
Previously, family pension was automatically granted to the spouse of a deceased government servant or pensioner. However, the new rule empowers women to decide the beneficiary of the pension.
By allowing female government employees or pensioners to specify their preferred nominee, the government aims to ensure that women do not face discrimination or loss of rights in family pension matters, DoP&PW said.
Union Minister of State, Jitendra Singh, emphasised that the amendment aligns with Prime Minister Narendra Modi's commitment to providing equitable, just, and legitimate rights to women in various sectors.
This includes initiatives like the Permanent Commission to Women in the Armed Forces and the Women’s Reservation Amendment in Parliament.
Procedure for requesting family pension nomination
According to an office memorandum from the DoP&PW, female government servants or pensioners must submit a written request to their Head of Office, indicating that family pension should be granted to their eligible child/children in precedence to their spouse, in the event of their demise during ongoing proceedings.
If the female government servant or pensioner passes away during the proceedings, the family pension will be disbursed accordingly.
Widowers and minor children
The notification clarifies that if a woman employee is survived by a widower with no eligible child, the family pension will be payable to the widower.
In cases where the widower is the guardian of a minor child or a child suffering from a mental disorder, the family pension will be payable to the widower, as long as he remains the guardian.
