Adani Coal Import Case: Supreme Court stays Bombay High Court relief on DRI plea

The Supreme Court on Wednesday stayed a Bombay High Court ruling that gave relief to the Adani Group in an alleged case of overvaluation of Indonesian coal imports between 2011 and 2015.

The Supreme Court on Wednesday stayed the Bombay High Court ruling that gave relief to the Adani Group in an alleged case of overvaluation of Indonesian coal imports between 2011 and 2015. The apex court has also revived the Directorate of Revenue Intelligence (DRI) investigations into alleged over invoicing of imported coal by Adani.

The Bombay High Court had in mid-October 2019 ordered quashing of all letter rogatories (LRs) sent by DRI to countries, including Singapore, against three Adani group companies accused of overvaluing Indonesian coal imports between 2011 and 2015.
A Letter Rogatory is a formal request between two countries party to a Mutual Legal Assistance Treaty (MLAT), seeking judicial assistance in accessing information on an offshore entity in connection with an ongoing probe.
The DRI probe is not restricted to Adani alone, the agency is probing 40 companies including ADAG and Essar group companies. Over Rs 29, 000 crore of coal imported between 2011 and 2015 is the subject matter of DRI probe.
