The Supreme Court on Tuesday, November 7, observed that the current situation of the seizure of digital devices by the Enforcement Directorate is dangerous, and noted the absence of guidelines and scope for misuse.
The court said privacy has been declared to be a fundamental right. The apex court directed that there must be a balancing act and guidelines must be issued for the exercise of powers.
The court was hearing a plea by the Foundation for Media Professionals, Amazon seeking guidelines for the ED searching and seizing devices of the accused.
