Delhi HC directs restaurants to rename 'service charge'; avoid misleading customers with interim order

The court observed that the words 'service charge' give an impression of being a government-backed levy and asked the petitioners to state if they have any objections to changing the term to 'staff charges' or 'staff welfare fund' etc to avoid any confusion.

The Delhi High Court on Wednesday said that its interim order staying a ban on automatic levy of service charge on food bills cannot be shown by restaurants to the customers in a manner to mislead  that the charge has been approved by the court. It also asked the bodies representing the restaurants to change the term 'service charge' to 'staff welfare fund' or 'staff welfare contribution'.
Justice Prathiba M Singh, who was hearing the pleas by two restaurant bodies challenging the July 4, 2022 prohibition by the CCPA, observed that the words 'service charge' give an impression of being a government-backed levy and asked the petitioners to state if they have any objections to changing the term to 'staff charges' or 'staff welfare fund' etc to avoid any confusion.
"For a long time, most of us thought that the service charge is being taken by the government. That is where the problem is because people think service charge is like a service tax. A consumer doesn’t know the difference between service tax, GST etc. because people think it is being taken by the government. I have come across a lot of people who think like that,” Justice Singh said during the hearing.
